Terms of Service

These terms are an agreement between you and Foundry Labs LLC, the company that operates SETT. We wrote them to be read. Where the law calls for specific legal language we use it; everywhere else we use plain English. Our Privacy Policy and Health Disclaimer are part of these terms.

1. Acceptance of these terms

These Terms of Service ("terms") are a binding agreement between you and Foundry Labs LLC ("Foundry Labs", "we", "us", or "our"), the operator of SETT at sett.fit and in the SETT app. You accept these terms by checking the acceptance box when we ask, by creating an account, or by using SETT. The Health Disclaimer and the Privacy Policy are incorporated into these terms by reference. If you do not agree to everything here, do not use SETT.

2. Eligibility

You must be at least 18 years old to use SETT. We set the age at 18, higher than the minimum for most online services, because SETT suggests physical training and physical training carries real risk of injury. By using SETT you represent that you are at least 18 and legally able to enter into this agreement, and that these terms are not prohibited for you under the laws of the place you live.

3. Your account

Keep your sign-in secure. Activity under your account is your responsibility, so tell us right away if something looks wrong.

You sign in to SETT with a code sent to your email address or through Google. Because of that, the security of your SETT account depends heavily on the security of your email account. Protect it.
You agree to give us an accurate email address and keep it current.
You are responsible for all activity under your account. If you believe someone has accessed it without permission, contact us promptly at hello@sett.fit.
One account per person. Do not share, sell, or transfer your account.

4. SETT Pro subscriptions

Pro is billed through Stripe, monthly or yearly, and renews automatically. Cancel anytime; you keep Pro until the end of the period you already paid for. We do not refund partial periods.

Billing. SETT Pro is an optional paid subscription billed through Stripe. We never see or store your full card details; we keep only a Stripe customer ID, as described in the Privacy Policy.
Cycles and renewal. Pro is offered on a monthly or yearly billing cycle at the price shown at checkout. Your subscription renews automatically at the end of each cycle until you cancel.
Free trial. New subscribers may be offered a 14-day free trial. You will not be charged until the trial ends, and you can cancel during the trial at no cost.
Cancellation. You can cancel at any time in the app or through the Stripe billing portal. Cancellation takes effect at the end of the current billing period, and you keep Pro features until then.
Refunds, stated plainly. We do not refund partial billing periods. If you cancel partway through a cycle, you keep Pro until the cycle ends and the unused time is not refunded. If we materially fail to provide the service you paid for, or where a refund is required by law, contact us at hello@sett.fit and we will make it right.
Price changes. If we change Pro pricing, we will give you at least 30 days notice before the new price applies at your next renewal. If you do not agree with the new price, cancel before it takes effect.
Prices may be subject to applicable taxes, which are your responsibility.

5. Health, safety, and assumption of risk

This is the most important section of these terms. Please read it in full, together with our Health Disclaimer, which is part of these terms.

SETT is not medical advice, and it is not a substitute for care from a physician, physical therapist, or qualified coach.
Talk to a doctor before starting any training program, especially if you have a pre-existing condition, a current injury, or you are pregnant.
All physical training carries an inherent risk of injury, up to and including serious injury. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS OF TRAINING WHILE USING SETT. YOU TRAIN AT YOUR OWN RISK.
SETT's coaching suggestions, meaning the weights, reps, and progressions it proposes, are computed from your own logged data. They are suggestions, not prescriptions. You are always the final judge of what your body can safely do on a given day. If a suggested load feels wrong, do not attempt it.
Pain is not the same as effort. If you feel pain, dizziness, or anything that feels wrong, stop immediately and seek medical attention. Do not push through it because the app suggested a number.
Individual results vary. Nothing in SETT is a promise about your body or your outcomes.

6. Acceptable use

Use SETT for your own training. Do not break in, scrape, resell, or interfere with the service.

You agree not to:

use SETT for any unlawful purpose or in violation of these terms;
probe, breach, or circumvent any security or authentication measure, or access data or accounts that are not yours;
scrape, harvest, or bulk-extract data from the service;
copy, modify, or reverse engineer any part of SETT, except to the extent a law grants you that right despite this term;
resell, sublicense, or commercially exploit the service or its content;
interfere with the service, including overloading infrastructure or introducing malicious code;
impersonate anyone or misrepresent your affiliation with any person or entity.

7. Intellectual property

We own the app. You own your training data (see section 8).

Foundry Labs owns SETT: the software, design, branding, logos, exercise library, plan and routine content, and everything else in the service except the data you log (covered in section 8). We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use SETT for your own training while these terms are in effect. No other rights are granted. If you send us ideas or suggestions about SETT, we may use them without restriction or obligation to you.

8. Your training data and the license you give us

Your logged workouts, weights, and measurements are yours. You give us permission to store and process them so the app can work.

You own the data you log in SETT: workouts, sets, reps, weights, body metrics, and anything else you enter. You grant Foundry Labs a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display that data, and to compute coaching suggestions from it, solely to provide and improve SETT, consistent with our Privacy Policy. We do not sell your personal data. You can request an export of your data, or the deletion of your account, at any time by contacting hello@sett.fit; deletion works as described in the Privacy Policy, and this license ends when your data is deleted.

9. Disclaimer of warranties

SETT is provided as is. We work hard on it, but we cannot promise it will always be available or that every suggestion will be right.

SETT IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. In plain terms: we do not promise that SETT will be uninterrupted or error-free, or that any coaching suggestion is right for your body on a given day. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

10. Limitation of liability

We are not liable for indirect damages. In most cases, the most we owe you is what you paid us in the last 12 months.

TO THE FULLEST EXTENT PERMITTED BY LAW, FOUNDRY LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST DATA, ARISING FROM OR RELATED TO YOUR USE OF SETT. Our total liability to you for all claims, taken together, will not exceed the greater of the amount you paid us in the 12 months before the claim arose or 50 US dollars. Nothing in these terms limits any liability that cannot be limited by law, and some jurisdictions do not allow limits on incidental or consequential damages, so parts of this section may not apply to you.

11. Indemnification

If your misuse of SETT gets us sued, you cover our costs.

You agree to defend, indemnify, and hold harmless Foundry Labs and its officers, employees, and agents from any claims, damages, and costs, including reasonable attorneys' fees, arising from your breach of these terms, your misuse of SETT, or your violation of any law or the rights of any third party.

12. Termination

You can leave anytime. We can suspend or close accounts that break these terms.

You can stop using SETT at any time, and you can delete your account by emailing hello@sett.fit. Pro subscriptions are cancelled as described in section 4. We may suspend or terminate your account if you breach these terms, use SETT unlawfully, or put the service or other users at risk, and we will give you notice where practicable. On termination, your license to use SETT ends and your data is handled as described in the Privacy Policy. Sections that by their nature should survive termination do survive, including sections 5 and 8 through 15.

13. Changes to these terms

If we change these terms in a way that matters, we will tell you and ask you to accept the new version before you keep using SETT.

These terms are versioned; the version number and effective date appear at the top of this page. If we make a material change, we will notify you by email or in the app and ask you to accept the new version before continuing to use SETT. Non-material changes, like clarifications or typo fixes, may take effect when posted. We keep a record of which version you accepted and when. The current version is always available at sett.fit/terms.

14. Governing law

Arizona law applies to these terms.

These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Any dispute arising from these terms or from SETT will be resolved in the state or federal courts located in Arizona, and you and Foundry Labs each consent to venue and personal jurisdiction there.

15. Severability, entire agreement, and waiver

If a court knocks out one part of these terms, the rest still stands.

If any provision of these terms is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be, and the rest of the terms remain in effect. These terms, together with the Privacy Policy and Health Disclaimer, are the entire agreement between you and Foundry Labs about SETT. If we do not enforce a provision right away, we are not waiving it.
